Terms & Conditions

These Terms constitute a legally binding agreement between you (“you”, “the customer”) and Ace Outfitters (“we”, “us”, “our”). They apply together with our Privacy Policy, our Returns & Refunds Policy and our Shipping & Delivery Policy, which are incorporated into these Terms by reference.

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), and the Protection of Personal Information Act 4 of 2013 (“POPIA”). Nothing in these Terms is intended to limit any right you have under that legislation which cannot lawfully be limited.

Ace Outfitters is a trading name of Mace Clothing CC (registration number 2011/099531/23), a menswear retailer trading from 36 Bultfontein Road, CBD, Kimberley, 8301, South Africa, in operation since 1989. VAT number: 4490321934.

You must be at least 18 years old, or be placing an order under the supervision of a parent or legal guardian, to purchase from us. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete.

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised use of your account.

• We try to display product colours, sizing and details as accurately as possible, but slight variations between the Site and the physical item (due to screen display, lighting or batch differences) may occur and do not constitute a fault.
• All prices are displayed in South African Rand (ZAR) and, unless stated otherwise, are inclusive of VAT where applicable.
• Stock levels shown on the Site are indicative and updated regularly, but items may sell out in-store before the Site reflects this. Where an ordered item is unavailable, we will contact you to offer a substitute, a delayed delivery, or a full refund.
• We reserve the right to correct pricing or description errors at any time, including after an order has been placed. Where a genuine pricing error affects your order, we will contact you before processing payment and you may choose to proceed at the correct price or cancel.

Placing an order through the Site constitutes an offer to purchase, which we may accept or decline at our discretion — for example, where stock is unavailable, payment cannot be verified, or we suspect fraudulent or abusive use of the Site. A contract of sale is only formed once we confirm your order and successful payment has been received.

We may cancel or refuse any order, in whole or in part, where we reasonably suspect it is fraudulent, where pricing or stock information was materially incorrect, or where we are unable to fulfil it for reasons outside our control. Where we cancel a paid order, you will receive a full refund of amounts paid for the cancelled items.

Online orders are processed securely through PayFast, a licensed South African payment gateway. We do not store your full card details on our servers. Payment must be received in full before an order is processed for collection or delivery, unless we agree otherwise in writing.

You warrant that any payment method you use belongs to you or that you are authorised to use it. We reserve the right to withhold or cancel an order where payment cannot be verified.

Orders may be fulfilled by in-store collection, pickup, or delivery, as selected at checkout. Full details, including delivery areas, fees and estimated timeframes, are set out in our Shipping & Delivery Policy.

Your rights to cancel an order, return goods, and claim under warranty for faulty or defective goods — including your cooling-off rights under the ECTA for goods bought online, and your rights under the CPA — are set out in full in our Returns & Refunds Policy. Nothing in these Terms limits those statutory rights.

You agree not to use the Site to:

• Attempt to gain unauthorised access to our systems, other users’ accounts, or any non-public part of the Site;
• Upload or transmit any unlawful, harmful, defamatory or fraudulent content;
• Interfere with the proper functioning of the Site, including via viruses, bots or scraping tools; or
• Use the Site for any purpose that is unlawful or prohibited by these Terms.

We may suspend or terminate access to the Site for any user who breaches this section.

All content on the Site — including the Ace Outfitters name and logo, text, graphics, photographs and layout — is owned by or licensed to us and is protected by South African and international intellectual property law. You may not reproduce, distribute or otherwise exploit any of this content without our prior written consent, other than for your own personal, non-commercial use of the Site.

The Site may link to, or rely on, third-party services such as PayFast (payments), courier or delivery partners, and social media or messaging platforms such as WhatsApp, Instagram and Facebook. We are not responsible for the content, policies or practices of these third parties, and your use of them is subject to their own terms and privacy policies.

Our collection and use of your personal information is described in our Privacy Policy, which forms part of these Terms.

To the maximum extent permitted by law, the Site and its content are provided “as is” without warranties of any kind beyond those we cannot lawfully exclude under the CPA. We do not guarantee that the Site will be uninterrupted, error-free or free of harmful components.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental or consequential loss arising from your use of the Site or a purchase made through it. Nothing in this section limits our liability for gross negligence, fraud, or any liability that cannot lawfully be excluded or limited, including your rights under the CPA.

You agree to indemnify and hold Ace Outfitters harmless against any claim, loss or damage arising from your breach of these Terms or your misuse of the Site, save to the extent caused by our own negligence or wilful misconduct.

We will not be liable for any delay or failure to perform our obligations where this results from circumstances beyond our reasonable control, including load shedding, network or courier outages, natural disasters, civil unrest, or other events of force majeure.

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Site will be subject to the non-exclusive jurisdiction of the South African courts. Before pursuing formal legal action, we encourage you to first contact us so we can try to resolve the matter directly — see “Contact Us” below. Consumers also retain the right to refer unresolved disputes to the National Consumer Commission or the relevant consumer goods and services ombud.

We may update these Terms from time to time, including once Ace Outfitters finalises its own complete terms and conditions. The version published on the Site at the time you place an order will apply to that order. We recommend reviewing this page periodically.
